• “TNM Trivia Campaign 2024” – Terms and Conditions

  PLEASE PAY SPECIAL ATTENTION TO THE CONDITIONS NOTED BELOW AS PARTICIPATION IN THIS COMPETITION WILL CONSTITUTE AS AN AGREEMENT AND YOU ARE REQUIRED TO COMPLY WITH THESE TERMS AND CONDITIONS.

  TNM RESERVES THE RIGHT, AT ITS DISCRETION, TO CHANGE, MODIFY, ADD, OR REMOVE PORTIONS OF THESE TERMS AND CONDITIONS AT ANY TIME BY POSTING THE AMENDED CONDITIONS. PLEASE CHECK THESE TERMS AND CONDITIONS PERIODICALLY FOR CHANGES. YOUR CONTINUED PARTICIPATION IN THE COMPETITION AFTER THE POSTING OF CHANGES CONSTITUTES YOUR BINDING ACCEPTANCE OF SUCH CHANGES.

  YOUR ACCESS TO AND PARTICIPATION IN THIS COMPETITION WILL MEAN THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

  About the Competition

  Kuphaka Makwacha is a USSD-based trivia competition where you need to answer general knowledge questions. By answering the questions correctly, you can earn points. Each point is counted as an entry into one or more of the various prize draws offered as part of the competition. In order to participate, you need an active cellphone number on the TNM network from which you can dial the advertised USSD code and follow the prompts to register as a participant. Questions will then be presented to you on the USSD menu which you can answer by replying with the number (1 or 2) corresponding to the answer you believe is correct. Participation is free (there is no charge for dialing the USSD code) but you have the option to subscribe to the VIP service which is charged for and billed daily from your airtime. As a VIP subscriber, you may answer additional questions and receive more points for your answers. The following terms and conditions apply to your participation in the Kuphaka Makwacha trivia competition (“Competition”)

  Condition 1 - Not eligible to enter

  1.1 The Directors, Permanent or Temporary Employees of TNM shall not be eligible to win any prizes in this Competition.

  Condition 2 - Who can enter

  2.1 This Competition is open to all TNM customers (both prepaid and postpaid).

  Condition 3 - How to enter, price & how to opt-out

  3.1 In order to participate in this Competition, the TNM customer (“You”) should:

  1. Select the activation option for the Competition on the *567# USSD menu;
  2. Complete the activation instructions on the http://mytnm.mobi portal; or
  3. Subscribe to questions in Trivia by dialing *54545#

  3.2 Subscription to the VIP level the trivia game is charged at MK50.00 per day

  3.3 Subscription to one of the promoted content services costs MK50.00 per day for each service You choose to subscribe to.

  3.4 TNM or it’s authorized agents will contact the winners once the draw is made.

  3.5 The winner should be the owner of the Mobile Subscriber Integrated Services Digital Network-Number (MSISDN) (cellphone number) used to participate in the Competition.

  3.6 Any dispute of ownership of the MSISDN will result in that MSISDN being immediately disqualified from this Competition without recourse.

  3.7 If you no longer wish to participate in the free or VIP part of the Competition, you can opt out by:

  1. Dialing *54545# and go to “My Profile” and select opt out;
  2. Opt out of content services via *567#

  Condition 4 - Competition Period and Rules

  4.1 This Competition will run from 18 November 2024 until 24 March 2025, both days included. TNM may in its sole and absolute discretion extend or curtail the duration of the competition at any point during the competition period. (“Competition Period”)

  4.2 The Competition will run weekly (Monday to Sunday) and will run daily from 00:01 to 23:59, with exception to the last week of the Competition, which will run from Monday, 18 Nov 2024 until Thursday, 24 March 2025 at 23:59.

  4.3 You will be awarded points for taking any one of the following actions while participating in the Competition. Each point is equal to one entry into the applicable draw.

  4.4 Should you choose to subscribe to the VIP service, you will earn double the number of points for each subsequent action while You remain subscribed to the VIP service. For example, if You are a free Customer, You will earn 100 points by answering the question correctly. However, if you are a VIP Customer, You will earn 200 points per correct question. The additional points awarded are applicable to the same draws as the points awarded for the original action(s).

  Condition 5 - Prizes

  5.1 Participants in the Competition stand a chance to win the one of the following prizes over the Competition Period:

  1. Free Trivia subscribers stand a chance to win one of 7500 daily airtime prizes to the value of MK500.00. Winners will be selected randomly from the pool of qualified entries.
  2. Participants who successfully subscribe to the VIP or content services stand a chance to win one of 7500 daily airtime prizes to the value of MK1000.00. Winners will be selected randomly from the pool of qualified entries.
  3. Participants who successfully subscribe to VIP or one or more content services promoted during the Competition stand a chance to win one of 28 weekly cash prizes to the value of MK100, 000. Winners will be selected randomly from the pool of qualified entries
  4. Participants who successfully subscribe to VIP or one or more content services promoted during the Competition stand a chance to win one of 28 weekly cash prizes to the value of MK50, 000. Winners will be selected randomly from the pool of qualified entries.
  5. Participants who successfully subscribe to the VIP level or more content services promoted during the Competition stand a chance to win the grand prize of MK3,000,000 which will be shared between 4 customers. (1X MK2,000,000 and 3X MK750,00). Winners will be selected randomly from the pool of qualified entries. Winners will be drawn at the end of the competition
  6. In the event that the winner is unreachable or for some other reason is disqualified, the runner up will be the remaining player with the highest points balance, and so on.

  5.2 Draws for the daily prizes will be conducted daily throughout the Competition for the previous day.

  5.3 Draws for the weekly prizes will be conducted each Tuesday throughout the Competition for the previous week.

  5.4 You can only win one prize from Category C and D as outlined above. So, for example, if You win a MK 50 000 weekly cash prize, You will be disqualified from the draw for subsequent weeks but will remain eligible for the daily and grand prize draws.

  5.5 VIP participants must have had an active subscription during the time of the draw in order to qualify for entry into the draw.

  5.6 Content service subscribers must have at least one active subscription during the time of each draw in order to qualify for entry into the draw.

  5.7 You will have the opportunity to re-claim your previously earned points in the event that You accumulate points, opt-out of participation and subsequently opt back in to participation.

  Condition 6 - Prize collection

  6.1. Airtime prizes will be credited to the account associated with the MSISDN selected as the winner for that airtime draw.

  6.2. Cash prizes will be paid to qualified winners via an Electronic Funds Transfer into the winner’s Mpamba account.

  6.3. If You win the cash prize and You do not have a Mpamba account, You will be required to register in order to remit funds.

  6.4 Cash prizes are inclusive of all applicable fees and deductions, i.e Mpamba cash pay out fee and tax deductions equivalent to 5% of the value of the cash prize. Therefore all applicable fees and deductions are to be deducted from the cash prize amount before being paid out to the winner and the winner has no claim whatsoever against TNM, or any other third parties for payment of such fees and deductions.

  6.5. Prizes are not transferable into cash.

  6.6. Grand Prizes not collected 4 weeks after the end of the Trivia will be null and void.

  Condition 7 - Competition draw

  7.1. The draw for daily airtime winners will occur daily for the duration of the Competition. Airtime winners will be notified by SMS only.

  7.2. The draw for weekly cash prize winners will occur every Tuesday throughout the Competition for the previous week.

  7.3. Airtime winners will not be subject to the content of condition 9.

  7.4. After the draw, TNM will make attempts to contact the selected MSISDN (winner) on the mobile number (MSISDN) used to participate in the Competition in order to verify the owner’s personal details (proof of identification and address) and inform the winner of their prize. On the third failed attempt, an SMS will be sent to the winner’s MSISDN informing them to contact the TNM Contact Centre (105 for prepaid and 900 for postpaid) before the end of the day, 12:00 midnight, on that specific day.

  7.5. Should the participant fail to make such contact by 12:00 midnight, the prize shall be forfeited to the next drawn customer (alternate) and the process shall be repeated where necessary.

  7.6. TNM’s decision is final and no correspondence in this regard will be entertained.

  7.7. The draws will be done under the supervision of TNM’s internal auditor and the entries drawn will be determined as the winners. The decision of the auditors shall be final and binding, and TNM will not entertain any further correspondence in this regard.

  Condition 8 - Winner’s agree to have their photo and name published

  All participants agree and authorize TNM – for the purposes of this Competition – to identify, announced as the winner’s, have their names, images or photographs taken and published in the media which may include print, television, press and internet (at no additional cost to TNM). Failing to agree will result in such a participant forfeiting the prize to the next alternative winner.

  Condition 9 - Winners under 18 years old

  9.1 Should the winner be a minor under the custody and control of his or her parent(s) or guardian, the minor shall provide full particulars and proof of identification of said parent(s) or guardian to whom the prize will be delivered. Such particulars and proof shall state, inter alia, the nature of the relationship between the winner and the parent(s) or guardian concerned. Such prize shall be registered in the name of the parent or legal guardian.

  9.2 This Condition 9 will not apply to the Airtime Winners, nor will it be applicable to emancipated minors

  Condition 10 - General

  10.1. The prize and/or prize money is not transferable.

  10.2. Once the winners have taken possession of their prizes, all risk and responsibility associated with the prizes passes to the winner and TNM will in no way take responsibility or assume any liability for, or in connection with, the prizes or the use thereof.

  10.3. TNM reserves the right to review and change this Competition’s rules and format, or cancel it altogether.

  10.4. TNM reserves the right to disqualify any customer from participation in this Competition in light of any malpractice or manipulation of results that TNM believes has taken place.

  Condition 11 - Ownership

  As proof of ownership, the winner must produce the handset and SIM card used to participate in the Competition, along with the winner’s legal identification document.

  Condition 12 - Acknowledgement

  Winners may be required to sign acknowledgement of receipt of the prize.

  Condition 13 - Binding agreement and indemnity

  13.1 By participating in this Competition, the participants are bound and subject to all the Terms and Conditions of the Competition.

  13.2 TNM shall be indemnified against any technical errors beyond its reasonable control.

  Condition 14 - TNM’s standard Terms and Conditions apply

  All TNM’s standard Terms and Conditions apply. Subscription to and use of the content services are subject to the Terms and Conditions applicable to that service.
